These Terms of Service ("Terms") govern your use of aimitek.eu and purchases made from aimitek, trading as Aimitek ("Aimitek", "we", "us", or "our"). By accessing our website, creating an account, requesting a quotation, or placing an order, you agree to these Terms. If you do not agree, do not use the Services.

These Terms must be read together with our Privacy Policy, Shipping Policy, Return & Refund Policy, and any product-specific warranty, quotation, or order confirmation. Mandatory consumer rights in your country remain unaffected.

2. Eligibility and Accounts

You must have legal capacity to enter into a binding contract. If you purchase on behalf of a company or organization, you confirm that you are authorized to bind it.

You are responsible for providing accurate, current information and for maintaining the confidentiality of your account credentials. Notify us promptly if you suspect unauthorized account use. We may suspend or close an account where reasonably necessary to protect customers, Aimitek, or the Services.

3. Products and Information

Aimitek supplies professional electronic and material-testing instruments and related accessories. We make reasonable efforts to present product descriptions, specifications, compatibility information, images, availability, and prices accurately. Manufacturers may revise specifications, firmware, packaging, or accessories without notice, provided the supplied product remains materially consistent with the contract and applicable law.

Website content is general product information and is not engineering, safety, calibration, certification, or application-specific advice. Before purchase and use, confirm that the product, probes, leads, ratings, options, interfaces, and certifications are suitable for your intended application and jurisdiction. 4. Quotations and Orders

Products displayed on the website are invitations to place an order. Your order is an offer to purchase. An automated acknowledgment confirms receipt but does not necessarily mean the order has been accepted.

A contract is formed when we send an order acceptance or shipping confirmation, accept payment and begin fulfillment, or otherwise expressly confirm acceptance. We may reject or cancel an order before acceptance for reasons including pricing or description errors, lack of stock, payment failure, suspected fraud, export restrictions, or inability to deliver. If payment has been taken for a cancelled order, we will refund it.

Formal quotations are valid for the period stated in the quotation. If a quotation conflicts with these Terms, the quotation controls only for the specific transaction and only to the extent of the conflict.

5. Prices, Taxes, and Duties

Prices and currencies are shown on the website or quotation. Prices may change before an order is accepted. The checkout will indicate whether applicable VAT, sales tax, shipping, duties, or other charges are included.

For cross-border shipments not expressly sold on a delivered-duty-paid basis, the recipient is responsible for import VAT, sales tax, customs duties, brokerage, and local fees. Business customers are responsible for providing accurate tax and exemption information and for accounting for taxes as required by law.

6. Payment

You authorize us and our payment providers to charge the selected payment method for the order total. Payment methods and any applicable payment terms are shown at checkout or in the quotation. We may perform payment and fraud checks and may request reasonable verification before accepting or shipping an order.

Title to products passes only after we receive full cleared payment, unless mandatory law or an agreed written term provides otherwise.

We accept Shop Pay, Visa, Mastercard, American Express, Apple Pay, Bancontact, Google Pay, and UnionPay.

7. Shipping and Delivery

Shipping is governed by our Shipping Policy and any Incoterm or delivery term stated in a quotation or order confirmation. Delivery dates are estimates unless expressly guaranteed in writing. We are not responsible for delays outside our reasonable control, but we will provide the remedies required by applicable law.

You must provide a complete delivery address and cooperate with customs or carrier requests. Risk of loss passes as described in our Shipping Policy and applicable mandatory law.

8. Returns, Cancellation, and Refunds

Returns, statutory withdrawal, cancellations, and refunds are governed by our Return & Refund Policy. Consumers may have mandatory cancellation, conformity, legal guarantee, and warranty rights that cannot be restricted by these Terms.

9. Product Use and Safety

Test and measurement instruments may be used around hazardous voltages, currents, temperatures, machinery, batteries, lasers, or other risks. You must:

  • read and follow the manufacturer's manual, warnings, ratings, and safety instructions;
  • use properly rated probes, leads, accessories, protective equipment, and measurement categories;
  • ensure installation, maintenance, and use are performed by suitably qualified persons;
  • not exceed voltage, current, power, environmental, or isolation ratings;
  • comply with applicable electrical, workplace, laboratory, export, and safety laws; and
  • stop using a product that is damaged, behaves unexpectedly, or may be unsafe.

You are responsible for validating measurement methods and results for your application. Unless expressly certified for that purpose, products must not be used as the sole protective, medical, life-support, emergency shutdown, or other safety-critical system.

10. Calibration, Accuracy, and Software

Published accuracy specifications apply only under the manufacturer's stated conditions and calibration interval. Calibration certificates, traceability, accredited calibration, software options, licenses, and firmware features are included only when expressly listed in the product description, quotation, or order confirmation.

Software, firmware, applications, and protocol tools may be subject to separate manufacturer or third-party license terms. You must not bypass licensing, security, or access controls.

11. Warranties and Conformity

Products may include a manufacturer's commercial warranty described on the product page or in supplied documentation. Warranty coverage may depend on product registration, serial number, territory, authorized use, and manufacturer procedures.

Commercial warranties are additional to, and do not replace, mandatory legal guarantee or conformity rights available to consumers. To request service, contact info@aimitek.eu with the order number, serial number, and a description of the issue.

12. Intellectual Property

The website and its original text, design, graphics, logos, product selections, and other content are owned by Aimitek or used under license and are protected by intellectual property laws. Manufacturer names, trademarks, product images, datasheets, and videos belong to their respective owners.

You may view and print website content for personal or internal business purchasing purposes. You may not reproduce, republish, sell, scrape, modify, distribute, or commercially exploit website content without permission, except as permitted by law.

13. Acceptable Use

You must not use the Services to:

  • violate law, intellectual property rights, privacy rights, export controls, or sanctions;
  • submit false, fraudulent, misleading, or harmful information;
  • introduce malware, disrupt security, probe systems, or gain unauthorized access;
  • interfere with another user's access or with store operations; or

14. Reviews and User Content

If you submit a review, image, technical comment, or other content, you confirm that it is accurate, lawful, and does not infringe third-party rights. You grant Aimitek a non-exclusive, worldwide, royalty-free license to host, reproduce, translate, format, and display that content for operating and promoting the Services, subject to applicable privacy law.

We may moderate or remove content that is unlawful, irrelevant, deceptive, abusive, or violates these Terms. We do not guarantee publication of any submission.

15. Third-Party Services and Links

The Services may link to manufacturer websites, manuals, videos, payment providers, shipping carriers, or other third-party services. We do not control third-party content or availability. Your use of those services may be governed by separate terms and privacy policies.

16. Service Availability and Changes

We may update, suspend, or discontinue website features or product offerings. We do not guarantee uninterrupted or error-free website access. This does not affect accepted orders or rights that have already arisen.

17. Disclaimers

To the maximum extent permitted by law, the website and general informational content are provided on an "as available" basis. We do not warrant that website content is error-free, complete, or suitable for every engineering application.

Nothing in these Terms excludes an express product commitment, a manufacturer's warranty, or any statutory right that cannot lawfully be excluded.

18. Limitation of Liability

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, willful misconduct, breach of mandatory product liability law, or any liability that cannot legally be excluded.

For consumers, we are responsible for foreseeable loss caused by our breach of contract or failure to use reasonable care, subject to applicable law. We are not responsible for business losses suffered by a consumer.

For business customers only, and to the maximum extent permitted by law, neither party is liable for indirect or consequential loss, loss of profit, loss of production, loss of data, or loss of business opportunity. Aimitek's aggregate liability arising from a transaction will not exceed the amount paid for the product giving rise to the claim, except where a higher liability cannot lawfully be limited.

19. Indemnity for Business Users

If you use the Services as a business, you agree to indemnify Aimitek against third-party claims, losses, and reasonable costs arising from your unlawful misuse of the Services, prohibited resale or export, infringement of third-party rights, or use of a product contrary to documented safety requirements. This section does not apply to consumers acting outside a trade or profession.

20. Events Outside Our Control

We are not liable for delay or failure caused by events outside our reasonable control, including carrier disruption, customs action, natural disaster, epidemic, conflict, labor dispute, utility or network failure, government action, supplier interruption, or export restriction. We will take reasonable steps to reduce the effect and will provide any remedy required by mandatory law.

21. Export Controls and Sanctions

You must comply with applicable export control, sanctions, and import laws. You must not purchase, export, re-export, transfer, or use products for a prohibited destination, party, or end use. We may request end-user or end-use information and may refuse or cancel an unaccepted order where required for compliance.

22. Governing Law and Disputes

These Terms and any non-contractual obligations are governed by the laws of HONG KONG, without regard to conflict-of-law rules.

If you are a consumer, this choice does not deprive you of mandatory protections granted by the law of the country where you habitually reside. Consumers may bring proceedings in any court available under applicable consumer law. Business disputes are subject to the exclusive jurisdiction of the courts of HONG KONG, unless a written agreement states otherwise.

23. Changes to These Terms

We may update these Terms from time to time. The version applicable to a purchase is the version in effect when the order is accepted, unless a change is required by law or expressly agreed. Updated Terms will be posted with a revised date.

24. Severability and Waiver

If any provision is found unenforceable, the remaining provisions remain in effect. A delay in enforcing a right is not a waiver of that right.
